     The complaint is  filed under sec.12 of the Consumer Protection Act 1986 against the opposite parties seeking  direction   to replace the I phone  or to return its cost along  with insurance premium and other  cost incurred by the complainant.
  The case of the complainant in brief.
    The complainant had purchased  One Apple I phone having  632 GB(MQ3D2HNA) of space gray  colour from the  1st opposite party on 1/6/18 and paid  a premium of  insurance of Rs.2116.50, on the assurance of 1st opposite party in order to get protection coverage for his mobile from all defects.  Unfortunately complainant met with an accident on15/4/19 and thereby  the  aforesaid  mobile  was thrown  away from his pocket and display  got damage.  The very next day complainant approached the  1st opposite party to repair the same by  paying 5% of total purchase cost Rs.1300/- and 1st opposite party issued job sheet and voucher for the same and assured by the  latter that the mobile will be return within one week after curing the defects.   But after one week 1st opposite party issued  intimation  to complainant  that Rs.10400/- will be credited against the  total loss  after the depreciation  in ZGDP plus account.  the 1st opposite party return the job card and mobile phone without curing  the defects.  Alleging the  aforesaid act on the opposite parties deficiency in rendering service and indulgence  into  unfair trade practice on the part of the opposite parties, the complaint filed this complaint. 
  On issuance of notice opposite parties   has not  appeared before the Forum did not participate in proceeding  .  Hence opposite parties set exparte.
   The complainant filed proof affidavit.  Induce  of examination in chief and Exts A1 to A9 were marked on the side of complainant.  The evidence  led by the  complainant is sufficient to prove  his case.  Heard on merits.
    Ext.A1 which is the bill payment towards the insurance premium shows that complainant had  paid the insurance premium towards maintainance  of his phone in lose of any defect arises.  Ext.A2 is the receipt issued by 1st opposite party indicates that  the complainant remitted Rs.1300/- towards the repairing   charge.  Exts.A3&A4  are  the  job sheet and payment voucher  given by the 1st opposite party to the complainant.  Ext.A5 is  the  lawyer notice  issued by complainant to opposite parties.  Exts.A6&A7 are postal receipt and  AD card.  Ext.A8 is the lawyer notice  sent to 2nd opposite party which  was returned without  accepting  it.  Ext.A9 is the  postal  acknowledgment.  Hence it is evident from all there documents produced by the  complainant that  he suffered deficiency   in service and unfare  trade practice from the side of opposite parties.
      In the result, the complaint of the complainant  is allowed in part 
1.  The opposite parties   directed  to  pay the price of the Apple I phone of the complainant along with insurance premium paid by the complainant.
2. To pay the  compensation of Rs.3000/- to the complainant  along with Rs.1000/- as cost .
   This order to be complied by the  opposite parties   within  30 days of   receipt of the order,   failing which the  complainant shall be  at liberty to  execute  the  order as  per the  provisions  of Consumer Protection Act 1986
