1. This is an application U/S 12 of the C.P. Act, 1986 filed by the petitioner, Susovan Mitra, against the o.p., the proprietor, S.C. Iron Industrial Corporation, Furniture Unit, praying for a direction upon the o.p. for replacement of almiraha in place of the old one and to pay compensation of Rs. 50,000/-.   

2. The case of the petitioner is that he purchased an almiraha from the o.p. on payment of Rs. 7,050/- on 4^th February, 2014. On delivery of the said almiraha he found that the same was of sub standard quality with different colour shade. The petitioner requested the o.p. to replace the almiraha or to repair the  defect found therein but the o.p. refused to do the same compelling the petitioner to file the case.  

3. The o.p. though appeared in the case did not contest the same by filing version and ultimately the case is  heard ex parte against them.

4. The only point to be decided herein whether the petitioner is entitled to the relief as  prayed for ?

DECISION  WITH   REASONS      :

In support of the case the petitioner filed road challan as well as his  lawyer’s letter and also affidavit in support of his claim that he purchased almiraha and the said furniture was defective and in spite of his request the o.p. neither repaired the almirah nor replaced the same and not even paid him the purchase money. All the oral and documentary evidences went unchallenged and there is nothing to disbelieve the case of the petitioner.  

In the result, the application succeeds.

Court fee paid is correct.

      That the C. C. Case No. 667 of 2014 ( HDF 667  of 2014 )  be and the same is   allowed ex parte  with  costs  against  the O.P. 

      The petitioner is entitled to get replacement of his old almiraha by a new one of good standard quality or to get his purchase money of Rs.7050/- refunded and also to get compensation for a sum of Rs. 1,000/- for the mental agony and harassment within  30 days from the date of this order  failing the petitioner is  at liberty to put the order  into execution after expiry of the appeal period and also the awarded sum would accrue interest @ 9% p.a. till realization.

      Supply the copies of the order to the parties, as per rule.
