Heard Mr. Barun Prasad, the Ld. Advocate for the Appellant who contends that though the Complainant actually purchased the cell phone of Model 1600 but Model 1600 F was actually supplied by the dealer concerned.  The mobile set has been produced which shows a reference of Model 1600.  Mr. Prasad argues that the letter ‘F’ on a Hologram which is affixed some adhesive is inside the mobile set.  We are not in a position to hold from the aforesaid that the model itself is 1600F as we have no material to connect the said letter F with the model number indicated in the mobile set.  No expert opinion has also been produced in support of such contention of the Complainant.  In the circumstances we have no material to interfere with the impugned judgement and the appeal is dismissed.  Respondents are absent on calls.
