            This is a complaint filed under section 12 of the Consumer Protection Act 1986.

 

            2. Complainant is a school.  Dispute is with regard to supply of quality contents for developing the intellectual ability of students which is allegedly

offered by the opposite party as per an agreement executed between the complainant and opposite party.  The grievance of the complainant is that the opposite party failed to supply the offered service.  Since the complainant has not produced the copy of the agreement, the complaint thus, before proceeding further, was adjourned for preliminary hearing with a direction to produce the agreement. Thereafter complainant produced copy of the said agreement.  It is to be noted that the complainant made M/s. Educomp Solutions Private Limited as the opposite party and according to the complainant they executed the agreement for the purpose with the opposite party.  But when I go through the copy of agreement produced by the complainant, it can be seen that this agreement has been executed between the complainant and one smart class Educational Services Private Limited for the purpose afore said.  This document does not show that there is an agreement between the complainant and opposite party.  So the complainant has not made out a prima facie case against the opposite party herein.  So this complaint is to be dismissed.
