- The case of the Complainant is that the Complainant is a driver cum owner of one TATA ACE goods carrier vehicle with Regd. No. OD-17-R-1775 Engine No. O. LTDICRAIL08CPYS47720 and Chasis No. MAT535001kzc19883 which was purchased from Opposite Party dated 24/04/2019 and financed by TATA Motors Finance Ltd for a tune of Rs. 4,95,230/-(Rupees four lakh ninety five thousand two hundred thirty)only that, the Opposite Party is the proprietor of TaTa Motors, After the purchase of the said vehicle, the vehicle became defective on engine on Dt. 21/04/2021 and the vehicle was handed over the Opposite Party for rendering of service nad the same was handed over the petitioner on Dt. 28/04/2021 after due service. On Dt. 29/04/2021, the vehicle became again defective on engine and as per the service it is duty of the Opposite Party to repair the vehicle free of cost but the Opposite Party demanded Rs. 21,000/-(Rupees twenty one thousand) only for repairing charges. The vehicle has been kept in open space for which the vehicle is sustaining dexterous condition. For the act of the Opposite Party the Complainant got harassed and filed this petition.
- Perused the documents filed by the parties and it reveals that the Complainant is the owner of One TATA ACE goods carrier vehicle with Regd. No. OD-17-R-1775. The Opposite Party is the dealer as well as service provider of the aforesaid vehicle.
The invoice as well as job card issued by Opposite party Dt. 28/04/2021 reflects that the warranty period of the aforesaid vehicle has been expired. It is the duty of the Complainant to receive the vehicle after due payment of the repairing charges. The Opposite Party is not liable to pay for the vehicle after the warranty period.
Accordingly it is order.
O R D E R
The Complaint is dismissed against the Opposite party.
No cost to the Complainant.
