This is a complaint filed under section 12 of C.P. Act, 1986 praying to direct the opposite parties to replace new mobile in place of defective mobile phone with a same cost or in the alternative to refund the cost of mobile i.e., Rs.5,300/- along with interest @ 24% p.a. from the date of purchase i.e.,  03-11-2010 to till the date of realization, to pay Rs.10,000/- towards deficiency of service and for adopting unfair trade practice by way of selling defective mobiles, Rs.5,000/- towards compensation for causing mental agony and Rs.2,000/- towards costs of the complaint.    

 This C.C. coming on before us this day in the presence of  Sri M. Chennaiah Goud, Advocate, Mahabubnagar for the complainant and   the OP-1 party in person and the OP-2 having been set exparte and the matter having stood over for consideration till this day, this Forum delivered the following:

          Affidavit of the complainant not filed inspite of granting sufficient time.  Complainant is also called absent. There is no representation even on behalf of the complainant. This itself shows that the complainant himself is not interested in proceeding with the matter. Hence, under the said circumstances, we find that no useful purpose will be served by keeping the record pending.  The complainant is also once again called absent.  Hence, the complaint is dismissed U/s 13(2)(c) of C.P. Act.  No costs.

   Pronounced by us in the open Forum, on this the 30th day of January, 2012.
