            Neither the complainer nor his advocate found present on repeated calls. No steps taken by complainant since 26.08.2020. This is an year old case since 2017. In view of above circumstances and not attended the Commission consistently by the Complainant, the Commission dispose of the case in accordance to the Consumer Protection Act.

            Brief fact of the complaint is that, the complainant purchased a spice mobile hand set model spice 509 from the Opposite party no.1 on 18.12.2014 for Rs.7300/- vide Bill No.16. But the mobile was stopped functioning properly after few days. The defects in the mobile was the display was not shown and outgoing and incoming calls were not functioning. On 20.07.2015 the complainant reported the said defects to the opposite party no.2 vide Service Request No.:18102099F70092. And subsequently, the op no.2 demanded money to repair the said mobile to the complainant during the warranty period. The complainant denied paying the same to the Op no.2. The complainant being a college student lost his valuable time and money by approaching the opposite party no.2 several times. To redress his grievance, the complainant issued Advocate Notice to the opposite parties but all in vein. For which, the complainant filed this case for replacement of the old defective mobile with new one and compensation.

However, the complainant probably does not want to proceed in this case any further. Hence in the result, the present consumer complaint stands dismissed for non prosecution by the Complainant. No order as to cost.

              This case is disposed of accordingly.
