          The petitioner Prakriti Sarkar herself is present before the Court alongwith the ld. Lawyer. On behalf of the O.P., New Honda, Sanjit Sarkar, Sales Manager alongwith his ld. Lawyer is present before the Forum. Heard the ld. Lawyer on behalf of both parties. We have given our anxious consideration over the submissions made on behalf of them. It is understood that in compliance with order dt.07.01.2009 complainant, Prakriti Sarkar alongwith her expert had been to the showroom of New Honda on 27.01.2009. The expert Rafique Sk. Appears to have examined the vehicle and found the same is O.K. condition. Today the O.P. has brought the vehicle before the Consumer Forum. The complainant received the vehicle, in question, bearing No.WB 66E/9668 in O.K. condition and to this effect a receipt has been filed before this Court. There being no other dispute in as much as the vehicle in question has been received by the petitioner, we do not find any good reason to proceed with the case further and the case should be disposed of accordingly.

 

          It is therefore,                         ordered

that Malda D.F. Case No.50/2008 be and the same is hereby disposed of without any order as to cost.

 

          Let a copy of this order be supplied to both parties free of cost.
