The complainant has filed this complaint u/s 12 of C.P. Act, 1986 for illegal, negligent act of the OP for collection of blood from the body of the child of the complainant.
The case was fixed for admission hearing on different dates i.e. 30.10.14, 18.11.14, 04.12.14 26.11.14 and lastly on 18.03.15 but the complainant did not appear to get his complaint admitted.
From the record it appears that sufficient opportunities have already been given to the complaint but the complainant has not turned up even after specific order for admission hearing as an absolutely last chance i/d legal consequences. The same order was also seen by the Ld. Lawyer for the complaint but no step is taken on the date of admission hearing.
Considering the above circumstances, this Forum has no other alternative but to dispose of the case being not admitted.
Hence,
Ordered
that the Consumer Complaint No. 135/2014 be and the same is disposed of being not admitted.
Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post to the concerned parties as per rules, for information and necessary action.
