Both parties file hazira. Ld advocate for the petitioner has not pressed the petition filed on 26.5.2008 and files a petition praying therein to drop the case as the petitioner is unwilling to proceed with the case. Ld. Advocate for the O.P. raised objection and submits for dismissal of the case awarding cost for harassment.
 
          Hd. Both sides, considered. At this stage this Forum finds no other alternative but to pass an order for dismissal of the case. Proper fees paid.
 
Hence,                           ordered,
that D.F. Case No.18/2008 be and the same is dismissed for non prosecution. In the peculiar circumstances there will be no order as to cost.
 
          Let a copy of this order be given to both parties free of cost.
