            The complainant’s advocate is present and files hazira. Perused the complaint, office notes and documents filed by the complainant. Heard the complainant’s advocate on the point of admission. In the instant case it reveals from the complaint petition that the complainant is not a consumer under Consumer Protection Act, as he has not hired any service of the O.Ps.

            Section 2(d)(ii) Consumer means any person who hires or avails of any services for a consideration which has been paid or promised or partly paid and partly promised or under any system of deferred payment and includes any beneficiary of such services other than the person hires or avails of the services for consideration paid or promised or partly paid and partly promised or under any system of deferred payment, when such services are availed or with the approval of the first mentioned person but does not include a person who avails of such services for any commercial purpose.

            In view of the foregoing discussion and settled position of law, the complaint filed by the complainant stands rejected. The complainant is at liberty to file his case in proper forum having jurisdiction.
