Heard the Ld. Counsel for Complainant and OP- Principal in person. The case of the Complainant is that he was admitted into +3 1st year Arts in Khaira College, Khaira (OP) on 04.07.2013 with deposit of Admission fee for a sum of Rs. 3,150/- and was allotted a Roll Number as BA-13-143. There after he took his transfer to Balangi Mahavidyalaya, Sunhat, Balasore under ‘e’ category and took admission there on 31.08.2013. There after though the Complainant Student who was under the project of Student Academic Management System “SAMS” and applied to OP- College for return of Admission fees. The OP- Principal refused to return the same to him and hence, the complaint. The OP- Principal registered the complaint on the main ground that transfer of Complainant from Khaira College does not reveal his higher choice nor does the transfer satisfy the norms of SAMS and for which Complainant does not fulfill the claim.
Having heard the Parties and upon perusal of materials available on record it is noticed that the Complainant Student has already taken admission into +3 1st year Arts in Balangi Mahavidyalaya, Balasore having his Roll No. BA-13-143. In such a position of case when the Complainant Student is continuing his study in other college after availing transfer from OP- College he
deserves the refund of his Admission fees amounting to Rs. 3,150/- minus Rs. 100/- (Processing Fees). Thus the Complainant- Student deserves the refund of Rs. 3050/- from OP- College, which needs to be complied within 15 days from today after observing the Legal Formalities.
Accordingly, complaint is allowed but without any costs & compensations.
