The present dispute arises out of the complaint petition filed by the above named complainant alleging deficiency in service against afore mentioned O.Ps for non refund of deposited fees amount . The brief facts of the case has summarised here under.
That the O.P. No.1 approached and initiated the complainant in his residence at Padmapur for joining of his son in + 2 science. As per the request of the O.P. No.1 the complainant had joined his son namely Manas Ranjan Padhy in + 2 1 st. year Science during Ist. Phase in session 2016-2017 in his institution under the name and style Gyana Vikash Junior College. At the time of joining of the complainant’s son he had deposited Rs.25,000/- with a condition if the education and environment of the institution is not satisfy by the concern student the amount shall be refundable to the complainant. The infrastructure, environment, shortage of faculty and the fooding of the students is not satisfactory as such the son of the complainant became seek as such the complainant had discontinued the son’s studies within joining of 10 days from the O.Ps institution. The Govt. of Odisha, Higher Education Department, Bhubaneswar had made a circular to all the Principles of all the institution for refund of deposited amount if discontinued of the students at the time of admission forth with or else action will be taken against the institution vide his letter No. 23326 Dt. 16.8.2016. The complainant requested the O.P. No.1 to refund the deposited amount of Rs.25,000/- but the O.P. No.1 so far did not refunded the deposited amount. Hence this case. The complainant prays the forum direct the O.P. to refund the amount deposited a sum of Rs.25,000/- with @ Rs. 12% interest p.a. and such other relief as the hon’ble forum deems fit and proper for the best interest of justice.
On being noticed the O.Ps neither appeared nor filed written version before the forum, hence the O.Ps are set exparte to close the case.
Heard from the complainant. Perused the complaint petition, documents filed by the complainant.
FINDINGS.
During the exparte hearing the complainant examined himself and proved the payment of the money to the O.P towards admission fees a sum of Rs.25,000/- on Dt. 07.07.2016 which is marked as Annexure-I. The complainant also argued due to non refund of the fees amount the complainant suffered a lot of financial trouble and mental agony. The complainant prays the forum as the O.Ps not heard any grievance of the complainant till date so the O.Ps be directed to refund Rs.25,000/- to the complainant.
In the absence of any denial by way of written version from the side of the O.Ps. it is presumed that the allegations levelled against the O.Ps. deemed to have been proved. The complainant had paid amount for the good service as per O.Ps advise through E-Mail which intended with the O.P and the said payment is made for the consideration for the service. When the O.Ps have failed to give such service as per assurance for which the O.Ps have received the amount. It is deemed that the O.Ps were callous to the allegations and it amounts to deficiency of service.
Further the Govt. of Odisha, Higher Education Department, Bhubaneswar had made a circular to all the Principles of all the institution for refund of deposited amount if discontinued of the students at the time of admission forth with or else action will be taken against the institution vide his letter No. 23326 Dt. 16.8.2016. Copies of the order has been filed by complainant at the time pf hearing which is marked as Annexure- 2.
Hence to meet the ends of justice, the following order is passed.
ORDER.
In the result with these observations, findings the complaint petition is allowed in part on exparte against the O.Ps.
The O.P No.1 is ordered to Refund deposited admission fees a sum of Rs. 25,000/- to the complainant. The O.P No.1 is further directed to pay Rs. 1,000/- towards compensation for mental agony and unfair trade practice. The O.P. No.2 is directed to refer the matter to the O.P. No.1 for early compliance of the order.
The O.Ps are ordered to comply the above direction within 45 days from the date of receipt of this order. Serve the copies of the order to the parties.
