Complainant’s case is that on appraisal with the advertisement made by the OP-Education Institution located at Takatpur, Ps: Baripada in the Dist of Mayurbhanj, Odisha, she got admission in to the said Institution on 16.05.2016 and deposited Rs.39,000/- with the said Institution. Subsequently, Complainant’s version is that, she got information that the School had not been started and on query also no information received from the Training Schlool alleging unfair trade partice on the part of the OP this complaint is filed. On being noticed the OP-Education Institution did not appear before the Forum, we decided to proceed the case in exparte against the OP. While hearing the case and claim of the complainant, it came to our notice that the OP-Education Institution is located outside of limit of the Forum i.e. in the district of Mayurbhanj and the admission of the complainant was admittedly held at takatpur in OPs Institute and the admission fees amounting to Rs.39,000/- was also deposited by means of demand draft. It is not the case of the OP is having any branch within the territorial jurisdiction of this Forum and even no cause of action partly or wholly has been arising within the Forum’s jurisdiction. We therefore, hold the complaint of the complainant is not maintainable before this Forum for want of jurisdiction and it is rejected.
