The Decree Holder files hajira. JDR No.1, The Pradhan, Lahutara – II G.P. , Uttar Dinajpur, himself is present and  files one A/C payee cheque in the name of Raju Pasman vide Cheque No – 001734 dated 26/11/2014 of amounting to Rs 10,000/- (Rupees Ten Thousand only) drawn on Bank Of India, Tungidighi branch, Uttar Dinajpur.

The DHR himself is present and files two separate petitions praying to permit him to hand over the above mentioned cheque and another petition has filed by the DHR praying to disposed of this execution case on full satisfaction and also files photocopy of Identity Card  along with original.

The Original Identity Card submitted this day by the DHR is returned to him and other petitions are taken up for hearing.

Hd. both sides. Being asked by the Forum, the DHR submits that he is satisfied with the amount as mentioned in the cheque as stated above.

 Considered the prayer to hand over the cheque No – 001734 dated 26/11/2014 for Rs 10,000/- submitted by the JDR No- 01 is allowed.

Accordingly hand over the cheque as mentioned to the DHR on furnishing on proper receipt.

In view of the above discussion there is no bar to dispose of the case on full satisfaction. So, the E/R of W/A issued against the JDR No- 1 is recalled.

Hence, it is

ORDERED,

that the Execution Application No. 26/2012 be and the same is disposed on full satisfaction and recall the E/R of W/A.
