Orders in preliminary issue -

 

Whether the complaint is barred by limitation ?

  1. The clear case of the complainant is that their father died in August 2001 and the LRs of deceased father viz. complainant and his  siblings became entitled to the proceeds arising  out of RD maintained by the deceased father. One  “Narayani Madam” would not assist the complainant in any manner. Hence they waited till 2017 when a new Post Master took charge to claim the amount in the RD.
  2. We do not feel this is a believable story. Waiting till 2017 until the Post Master who did not help them retire and thereafter initiating proceedings to avail the RD amount is beyond any reasonable comprehension. No man of ordinary prudence would wait for 16 years for some official to retire, to initiate some procedures again.
  3. This is not a case where there is sufficient cause to condone delay. The cause of action had began in 2001. Some times in 2003 the bar of limitation started.  Hence there is a delay of nearly 16 years in filing this complaint. Even considering  that this complainant is a layman, the story of waiting 17 years for the official concerned to retire is unpalatable. 
  4. Hence the complaint is dismissed as grossly barred by limitation.  

            Pronounced in open court on this the 24th day of September, 2021.
