Ld. Advocate for the complainant is present.           

The case is taken up for admission hearing.

Perused  and considered the complaint petition along with the photocopy of the documents annexed thereto.

Heard Ld. Advocate for the complainant.

It has been stated in the complaint petition that the complainant used to sale its product to customers mainly cash on delivery and the complainant company used to deliver the product through Indian Post namely G.P.O., Kolkata, the opposite party herein by mode of VPP, SPCOD, BPCOD of Indian post and for that there was huge amount of transaction between the complainant and the opposite parties regarding their business. It is further stated that the business relation of the complainant with the opposite parties is since the year 2015.

It is apparent  on the face of the complaint that the transaction between the complainant and the opposite parties is purely for commercial purpose.

Therefore, the complainant cannot be considered as a consumer under section 2(7) of the Consumer Protection Act, 2019.

In view of the above discussion the instant case is not maintainable in law.

Fees pad correct.

Hence it is,

O R D E R E D

that the complaint case be and the same is dismissed without cost.
