Complainant’s case in short is that she opened recurring deposit accounts No. 7961843361 and 761843420 on 30.06.2012 for monthly deposit of Rs. 10,000/- and 5000/- respectively at Bermo Post Office, District Bokaro in which she deposited all the monthly installments and its maturity date was 30.06.2017 with maturity value of Rs. 7,46,510/- and Rs. 3,73,255/- respectively. Further case is that she entrusted the agent of O.P. an application for withdrawal of maturity value but she came to know on 30.06.2017 that only Rs. 6,57,567/- and Rs. 3,28,783/- respectively has been processed for payment causing total loss to the tune of Rs. 1,33,415/-. Inspite of issuance of legal notice having no impact, this case has been filed with prayer to direct the O.P. to pay Rs. 1,33,415/- (loss amount) with 12% per annum interest and Rs. 10,000/- as litigation cost.
O.P. appeared and has filed W.S. mentioning therein that there is no dispute regarding opening of the R.D. by the complainant and it is admitted fact that the complainant has received the maturity amount which is less than the schedule maturity amount. Further reply is that complainant applied of the withdrawal of the R.D. amount on 29.06.2017 and same was complied by 30.06.2017. Further reply is that the Neeta Kumari Sinha agent has applied for withdrawal but she has not been made party who is solely responsible for alleged any loss caused to the complainant hence it is prayed to dismiss the case.
On perusal of the reply of the O.P. it is admitted fact that complainant has opened above mentioned R.Ds. before the O.P. and its maturity date was 30.06.2017 but payment has been made less than the maturity amount. Nowhere the maturity value as alleged by the complainant has been controverted or objected by the O.Ps. It is further admitted case that the request of withdrawal of the maturity value of the R.Ds. was processed on 30.06.2017. Annexure-2 is the photo copy of savings bank account of the complainant in which payment of the maturity value of the above R.Ds. has been made which shows that on 17.07.2017 Rs. 3,28,783/- on 26.07.2017 Rs. 6,57,561/- has been credited in the account of the complainant. Therefore, it is very much clear that on the date of maturity i.e. on 30.06.2017 request of the complainant has been processed and it has been finally complied on 17.07.2017 and 26.07.2017 much after the date of maturity. Therefore, we are of the view that when request of the complainant was being processed on 30.06.2017 (on the date of maturity) then complainant was entitled to get full maturity value of her R.D. accounts but less payment has been made i.e. to the tune of Rs. 1,33,415/-. Therefore, we are of the view that complainant is entitled to get relief as prayed .
Accordingly prayer of the complainant is being allowed and O.P. the Postmaster, Bermo P.O. and Superintendent of Post Office, Head Post Office, Giridih are directed to pay balance amount of the full maturity amount i.e. Rs. 1,33,415/- to the complainant within 60 days from receipt/production of the copy of this order along with interest @ 5% per annum from 01.07.2017 and also to pay Rs. 10,000/- as litigation cost within above mentioned period.
