Brief facts of complaint.
Complainant is a consumer of water connection bearing consumer number W.C.34 of Kerala Water Authority PH Sub Division, Palakkad. He used to get water till 16-07-2018. After that he did not get water from the opposite party. He had complaint several times before the opposite party about the non availability of water. Complainant submitted that till the date of filing complaint opposite party did not take any initiative to redress the grievance of the complainant. And also submitted that the opposite party insisted him to pay bill amount issued for the period from 16-07-2018. Hence the complaint. The complainant prays for an order directing opposite party to avail the uninterrupted water supply to the complainant, to rescind the bill for the period from the month of July 2018 and to pay an amount of Rs.50,000/- as compensation for mental agony.
Complaint was admitted and issued notice to opposite party. Opposite party appeared before the Forum and filed version contending the following:
As per the decision taken in the Board meeting they exonerated the complainant from paying arrears of the water bill of Rs.700/- which was issued for the period from the month of July 2018 to January 2019. Apart from that the opposite party restored the water supply to the complainant. Hence the complaint is to be dismissed.
Complainant and opposite party filed their respective chief affidavits. Ext.A1 and Ext.A2 were marked from the side of the complainant.
The following issues are considered:
- Whether there is deficiency in service on the part of opposite party?
- If so, what is the relief?
Issue 1& 2.
On going through the version and affidavit filed by the opposite party it is seen that opposite party redressed the grievances of the complainant as prayed for in the complaint. It is also seen that within two months from the date of filing of complaint opposite party redressed the grievance of the complainant by spending an amount of Rs.60,000/-. In the above circumstances we are of the view that complainant is not entitled to get compensation from the opposite party in the result complaint is dismissed without cost.
