JUDGEMENT

Mr. Sudhakar Senapothi, Member

          Complainant Rajendra Kanhar has filed this case u/s 35 of the CP Act-2019 alleging deficiency of service and harassment on the part of Opposite Party for non-payment of his dues by the Opposite Party and praying therein for direction to the Opposite Party to pay his dues and to pay cost and compensation for the loss and harassment sustained by him.

 

  1. Brief fact leading to the case is that the complainant is a beneficiary of the Central Government being a Scheduled Tribe (ST) under the self-employment scheme. Government of India has provided financial assistance to the complainant for construction of cowshed through ITDA, Baliguda. Even though he completed the work, the cost of material and labour was not given to him for which, he filed this case before this Commission for the reliefs as discussed above.
  2. After receipt of notice, Learned AGP entered appearance on behalf of the Opposite Party and filed written statement. In his written statement, the Opposite Party stated that the bill of the complainant has been prepared and the payment of the beneficiary has already been booked in online portal and the money has already been sent to his account. The complainant was present on the date of hearing and he admitted that the money has been credited in his accounts and further submitted that as the labour component has already been booked in the online portal, he is satisfied with the Opposite Party.
  3. As the principal grievance of the complainant is redressed and as his name has already been included in the online portal for payment, he is satisfied with the performance of the Opposite Party. And hence the order.

O R D E R

 

The complaint petition is accordingly disposed of. Parties to bear their own cost.
