None is present for the appellant though the appeal is called at 1.00 p.m. Adv. Mr A R Godbole is present for the respondent. He submitted that copy of impugned order is not filed by the appellant though long back direction was given to him for filing the same.  Hence, he requested that appropriate order may be passed.

Perusal of the earlier daily proceedings shows that the appellant’s Adv. Mr Prajapati had appeared lastly before this Commission on 07.04.2015 and on that date he was directed to file certified copy of the impugned order and it was not filed. Thereafter, the appeal came to be adjourned twice i.e. on 01.07.2015 and 21.09.2015 for filing the copy of the impugned order.  But on the said dates none had appeared for the appellant and certified copy of the impugned order was also no filed.  Therefore, appeal came to be adjourned till this date for appropriate order.  Today also none is present for the appellant and certified copy of the impugned order is also not filed.

Hence, the appeal is dismissed in default.

No order as to costs.

Copy of this order be supplied to both parties free of cost.
