          The case of complainant is that the complainant is an employee of Appollo Tyres Co. Ltd.  The employees of Appollo Tyres including complainant are insured by a group policy by the respondent.  On 17/6/07 while the complainant  was attending his work he  met with an accident and sustained  Lumbo Sacral strain.  He was taken to St.James Hospital and treated as inpatient.  He spent Rs.3,000/- for the treatment and the doctor advised to take complete rest for 42 days.  When the complainant  submitted his claim application it was repudiated as there is no visible injury.  This act of respondent is a deficiency in service.  Hence the complaint.

          2. Respondent remained exparte.

          3. Complainant filed affidavit and documents Exhibits P1 to P3  and Exhibit X1.  There is no evidence to the contrary.

          4. In the result the complaint is allowed and the respondent is directed to pay Rs.3,000/- (Rupees Three thousand only), the treatment expenses  claimed and Rs.2,000/- (Rupees Two thousand only) as compensation with costs Rs.500/- (Rupees Five hundred only) within a month from the date of receipt of copy of this order.
