ORDER

Complaint is partly allowed only on the basis of the deficiency in service partly made out in this complaint. Opposite party is hereby directed to pay an amount of Rs.10,935/- as reported by the surveyor and an amount of Rs.2,162/- towards the replacement of the diesel tank i.e., total amount of Rs.13,097/- with interest at the rate of 12% p.a. from 15-12-1999 till the date of payment with cost of Rs.500/-. This amount shall be paid within a period of two months without prejudice to the right of the complainant to approach a competent Civil Court. The complainant is at liberty to seek condonation of delay and approach proper Civil Court regarding his remaining claim. Send certified copies of this judgement and order to both parties by RPAD.
