Complaint is partly allowed only on the basis of the deficiency in service partly made out in this complaint.<br /> Opposite party is hereby directed to pay an amount of Rs.10,935/- as reported by the surveyor and an amount of Rs.2,162/- towards the replacement of the diesel tank i.e., total amount of Rs.13,097/- with interest at the rate of 12% p.a. from 15-12-1999 till the date of payment with cost of Rs.500/-. This amount shall be paid within a period of two months without prejudice to the right of the complainant to approach a competent Civil Court.<br /> The complainant is at liberty to seek condonation of delay and approach proper Civil Court regarding his remaining claim.<br /> Send certified copies of this judgement and order to both parties by RPAD.
