                                                          Complaint case no.        :         225 of 2024.

     Smt. Surinder Kaur wife of Baldev Singh, aged about 72 years, resident of House No.170-A, Village Chaurmastpur, Tehsil and District Ambala.

1. The Oriental Insurance Company Limited, Oriental House, A-25/27, Asaf Ali Road,  New Delhi-11002 through its Managing Direct/Director.

2. The Oriental Insurance Company Limited, Regional Office, LIC Building, 2nd Floor, Jagadhri Road, Ambala Cantt. through its Regional Manager.

          Complaint under Section 35 of the Consumer Protection Act, 2019

                   Today, the case was fixed for compromise in Lok Adalat. The learned counsel for the OPs has suffered a statement, which is recorded separately, to the effect that insurance company will settle the claim within thirty days on receiving the documents from the complainant, as mentioned in letter dated 02.03.2023.  Learned counsel for the complainant has also suffered a statement, which is recorded separately, to the effect that she has heard the abovesaid statement of the counsel for the OPs. Complainant will provide the documents which are available with her, within thirty days. Complainant will reserve the rights to file a fresh complaint if the matter has not been settled by the insurance company within the stipulated period and if the complainant is not satisfied with the settlement of the claim by the OPs.                                       

           In view of the aforesaid statement of the learned counsel for the complainant and learned counsel for the OPs, it is ordered that the insurance company shall settle the claim of the complainant within one month after receiving the requisite documents from the complainant. It is made clear that parties shall remain bound by aforesaid statements suffered by their counsel. In case, the claim was not settled by the insurance company within the stipulated period and not as per insurance policy and law, then complainant is at liberty to file afresh complaint. The present complaint is disposed of, accordingly in Lok Adalat. Assistant of this Commission is directed to handover the original documents, if any, to the complainant after retaining photocopies of the same on the file, on proper receipt and verification. Certified copy of this order passed in Lok Adalat be supplied to the parties concerned, free of costs, as per rules. File be indexed and consigned to record room, after due compliance.
