ORDER :- (Per Shri P.N.Kashalkar, Hon’ble Presiding Judicial Member)

(1)            On 26/07/2011, partner of the appellant was present since their advocate was not available.  Respondent was absent.  Hence adjourned to 07/09/2011.  On 07/09/2011, Adv.Rajendra Mishra for the appellant was present.  Respondent was absent.  We directed the appellant to do pagination and appeal was adjourned to 07/02/2012.  On 07/02/2012, none was present.  Hence, adjourned to 16/04/2012.  On 16/04/2012, both the parties were absent and again notices were directed to be sent to both the parties.  Notice sent to the respondent has come back as 'left' and notice sent to the appellant has been duly served.  However, both the parties are absent today.  It appears that the appellant is not interested to prosecute the appeal.  Hence, appeal is dismissed for default.  No order as to costs.
