Complaint under Section 35 of Consumer Protection Act, 2019.

Present:  Sh. Sahib Singh, proxy counsel for the complainant.

                Sh. Ram Mehra Sharma, counsel for the OP.

                         

                Today the case is fixed for evidence of the complainant, subject to the second last opportunity. No evidence is present. Request for adjournment by proxy counsel. Position remained the same for the last two adjourned dates. On perusal of the file, it reveals that complainant has already availed several effected opportunities including two last opportunity to conclude her evidence but she failed to do so. It appears that complainant is no more interested to pursue her case. Present complaint pertains to the year 2021. Further adjournment for the same purpose would not be justified at it would amount to wastage of precious time of this Commission.

                Hence, in view the above facts, the present complaint is hereby dismissed. However, complainant is at liberty to file fresh complaint on the same cause of action in the court of competent jurisdiction, if so desired. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
