ORDER

1.         Sh.D.C.Kumar-Advocate has filed his vakalatnama on behalf of OPs and made the following statement, recorded separately:-

“The OPs have no objection if a sum of Rs.3,37,586/- is released in favour of complainant out of the amount of Rs.6,85,350/- deposited by OPs in MA/118/2011 vide order dated 11.8.2011”

 

2.         Sh.H.S.Parwana-Counsel for complainant has made the following statement, recorded separately:-

“I have gone through the above statement made by counsel for OPs. I accept the same. The amount be released in favour of the complainant and the complainant has no objection if the remaining amount is released in favour of OPs. The order dated 3.10.2011 has been duly satisfied, so the execution petition be dismissed as fully satisfied”

3.         In view of the statement of counsel for the parties, it is ordered that a sum of Rs.3,37,586/- (Rs.2,30,641/- as per the order dated 3.10.2011 of the Hon’ble State Commission + Rs.99,945/- as interest + Rs.7000/- as costs of litigation), be released in favour of the complainant out of the amount of Rs.6,85,350/- deposited by OPs vide order dated 11.8.2011.

4.         As the order dated 3.10.2011 passed by the Hon’ble State Commission, U.T. Chandigarh, has been duly complied with, so the execution application is dismissed as fully satisfied. OPs are at liberty to withdraw the remaining amount, alongwith interest accrued thereon, as per law.

5.         Certified copy of this order be communicated to the parties free of cost.  After compliance file be consigned.
