Today is fixed for taking fresh steps for service of notice upon the OPs and postal track report of service upon OPs by the complainant as a last chance, i.d., necessary order will be passed.

No step is taken by the complainant.

On repeated calls, none appeared on behalf of the complainant. Ld. Advocate for the complainant is also not available.

It is now 3.30 P.M.

On perusal of the case record, it appears that the case was filed on 24.08.2021 and after admission, notices were issued on 16.09.2021 but no S/R received till 20.12.2021 and the complainant was directed to file postal track consignment report in respect of service of notices on 20.12.2021. Thereafter, on 11.02.2022 complainant was directed to take fresh steps upon the OPs and to file postal track consignment. Since then, the complainant did not either take fresh step or file postal track consignment. On 27.06.2022 and 01.09.2022, the case was also adjourned for taking fresh steps or for filing postal track consignment, but the complainant did not comply with the order. Even this day, the complainant did not take any steps.

Under the above facts and circumstance, it can be said that the complainant is not willing to proceed with the case further.

Hence,  it is

                                         ORDERED

that this case be and the same is dismissed for non-prosecution.
