Chander Bhan Garg, aged 76 years, son of Shri Telu Ram Garg, resident of House no.16, Gaushala Mandi, near Gohana Road, Panipat (Aadhar no.7010 3621 5606)

1.     The Oriental Insurance Company Limited, through its Divisional Manager/ authorized person, above OBC Bank, Meera Ghati Chowk, Karnal.

2.     M/s Raksha Health Insurance (TPA) office situated at 12/5, Mathura Road, Faridabad 121 003, through its Director/authorized person.

                                                                      …..Opposite parties.

 

Complaint under Section 35 of Consumer Protection Act, 2019.

                Shri Naveen Khetarpal, counsel for OP no.1.

                OP no.2 exparte.

       

                Today the case was fixed for consideration on the application for bringing the legal heirs of Chander Bhan Garg.

                At the stage, learned counsel for complainant suffered a separate statement to the effect that he does not pursue the present application of LRs dated 12.10.2021 and withdraw the same.

                Admittedly, the complainant had expired on 05.12.2019. The application moved by the learned counsel for complainant for bringing the LRs has been withdrawn. There is no justification to adjourn the case further as present complaint pertains to the year 2019.  Hence, this Commission has left with no option but to dismiss the present complaint.

                Thus, in view of the above, the present complaint is dismissed. However, the LRs of the complainant is at liberty to file fresh complaint before the appropriate Court, if so desired. Parties concerned be communicated of the order accordingly and file be consigned to the record room
