Final Order / Judgement

It is pointed out by the counsel for the opposite parties No.1 & 2 that surveyor and loss assessor of the opposite parties was appointed by the opposite parties in this case and as per the report dated 15.12.2016, amount of the loss was assessed at Rs.2,81,604/- and the complainant was asked to submit certain documents as detailed in para 5 of the preliminary objection in written version. Claim is still pending with the opposite party and they are ready to settle the same subject to furnishing the documents mentioned in serial No.1 to 3 in para 5 of the written version. The complainant has claimed that In the present circumstances, complainant  has suffered more loss than assessed by the insurance company. However, to meet  the end of justice and fairplay, complainant is directed to furnish all the documents to the opposite party within 20 days from today,  and opposite party will decide his claim within one month from the date of receipt of documents. It is also directed that opposite parties No.1 & 2 will assess all the points of damages raised by the complainant, at the time of final decision regarding claim. However, the complainant will be at liberty to file a fresh complaint on the same cause of action if his claim is repudiated by the opposite parties No.1 & 2. In terms of our order, present complaint is ordered to be disposed. Copy of the order be furnished to the parties free of costs. File be consigned to the record room.
