Complainant is not alive. Time granted for impleading legal representatives of deceased. Not impleaded till date. Counsel for complainant submitted that since the deceased was being represented by her daughter, Sabira there is no abatement. On going through the documents, we find that though Ms.Sabira had affixed her signature in vakalath, the proof affidavit is filed by deceased. Further upon the death of principal, the agent herein viz Sabira loses all authority.
Even though the counsel for complainant argued vehemently against this proposition we are not inclined to accept the contention of Mr. Dhananjayan that the complaint would not abate.
This complaint is disposed off as abated.
