Per Shri P.N.Kashalkar, Hon'ble Presiding Judicial Member:-

        This execution application is pending since long and it is the case of The Mahad Co-Op. Bank Ltd, Mahad that they have already made disbursement of amount of insurance claim of all 81 claimants including decree holder in the instant execution proceeding and accounts to that effect  were shown to Adv.Mr.Patwardhan and the decree holder.  Counsel for the The Mahad Co-Op. Bank Ltd, Mahad has also brought to the notice a letter received by Bank on 16/06/2004 wherein the decree holder in the instant case had informed the bank that he had examined the accounts and he was fully satisfied that as per directions of Hon’ble Supreme Court and Stated Commission, the Oriental Insurance Company has deposited certain amount in his account and he from time to time had withdrawn the said amount.  He also agreed to the transactions made by power of attorney holder which is reflected in his bank account and he also mentioned that the debit credit entries made by the bank in respect of his account were correct and he had no complaint and existing grievance against the bank.  This letter itself shows that amount was deposited by insurance company/judgement debtor with the bank has been disbursed to all the 81 claimants including decree holder herein and therefore, we hold that this award is fully satisfied. 

    Adv.Patwardhan appears to have some grievance against the power of attorney holder.  He may prosecute the complaint for his grievance by lodging proper suit against the power of attorney holder.  As such, this execution petition stands disposed of.  Hence, we pass the following order:-

                                        :-ORDER:-

1.           Execution petition stands disposed of.

2.           No order as to costs.

3.           Copies of the order herein be furnished to the parties.
