ORDER

16.7.08 Present Counsel for the parties. The counsel for the op has moved an application for issuance of a direction to the complainant to submit the claim paper with the op but till today he has not submitted the documents. Therefore, the op is unable to process the case. Notice of the application was given to the complainant who has opposed the same. We have considered the arguments advanced by the ld counsel for the parties. The controversy in this complaint relates to the death claim of the husband of the complainant who died on 16.8.2007 due to drowning. The complainant has obtained life insurance policy from the op which was n valid up to 22.7.2009. To avoid further delay in the settlement of the claim of the complainant, the complaint is disposed of with a direction to the complainant to submit the documents with the OP i.e DDR, Death certificate of the complainant and other relevant document within 15 days of the receipt of the copy of this order. Thereafter the op will settle the claim of the complainant within one month after getting the deficiency in these documents removed. In case of repudiation of the claim by the op the complainant is at liberty to file fresh complaint on the same cause of action. The parties are left to bear their own costs. Let the copy of the order be supplied to the parties free of cost under the rules and file be consigned to record. Neena Rani Gupta, Sarat Chander, Member Member
