F I N A L O R D E R
- This is an application U/S 12 of the C.P. Act, 1986 filed by the petitioner, Pinki Patra, praying for a direction upon the o.ps. to pay her monthly installment amount from April, 2013 to November, 2014 and also to direct them to pay the total value of the non convertible secured redeemable debentures amounting to Rs. 2,30,000/- to the complainant with interest till realization and to pay compensation of Rs. 50,000/- for physical and mental harassment.
- The case of the petitioner is that she purchased a total number of 2300 non convertible secured redeemable debentures of the value of Rs. 100/- per debenture from the o.ps. and thus invested sum of Rs. 2,30,000/- and got debenture certificates and received the money receipt against the same. The o.ps. paid him monthly installments upto March, 2013 and then denied to pay the installment of the said policy and she got only Rs. 18,400/-. As the o.ps. denied to pay him the total value of the debentures so the petitioner filed the case.
- The o.ps. in spite of good service did not appear in the case and not contest and so the case is heard ex parte against them.
- The only point is decided herein whether the petitioner is entitled to get the relief as prayed for ?
DECISION WITH REASONS :

In support of her case the petitioner filed before the Forum affidavit along with documents like the memorandum and articles of association of Omisha Realty India Ltd. and also the debenture certificates and the receipts which proved the case of the petitioners ex parte as all the above evidences went unchallenged and there is nothing to disbelieve the case of the petitioner which is proved ex parte.
In the result, the claim case succeeds.
Court fee paid is correct.
Hence,
O R D E R E D
That the C. C. Case No. 166 of 2015 ( HDF 166 of 2015 ) be and the same is allowed ex parte against the o.ps. with costs of Rs. 10,000/-.
The petitioner is entitled to get the total value of the said debentures amounting to Rs. 2,30,000/- with interest @ 9% p.a. from the date of purchase of debentures till realization and also entitled to Rs. 10,000/- as compensation for physical and mental harassment.
The o.ps. are directed to pay the above sum to the petitioner within 30 days from the date of this order failing the petitioner would be at liberty to put the final order in execution.
Supply the copies of the order to the parties, free of costs.
