This record is put up today on the strength of the put up petition filed by the complainant with a prayer for dismissal of the complaint for non-prosecution.

The complainant files another petition stating that the complainant has filed the instant complaint against the OP for repudiation of her insurance claim. The OP after getting the notice of the complaint contacted with the complainant and made a proposal for out of court settlement of her claim and as per the proposal of the OP, the complainant is agreed for out of court settlement and as a result the complainant is not willing to continue with this complaint and prayer is made to dismiss the complaint for non-prosecution, otherwise legal complication will arise.

The complainant has submitted one money receipt wherefrom it is evident that the complainant has received an amount of Rs. 4, 20,000=00 as settlement amount and the complainant has filed one photocopy of Draft in the name of the complainant-Rabiya Bibi being No. 117918, dated 10.09.2019 of Rs. 4, 20, 000=00 of HDFC Bank. The Complainant has also filed self-attested photocopies of her EPIC and Pan Card for her identification.

As the complainant by filing application stating that the matter has been amicably settled out of this Forum and she has  already received the settlement amount from the OP, so it is very much clear that there no grievance left against the OP, for which the complainant is not willing to proceed with this complaint further and prays for dismissal of this complaint.

Hence, it is

O r d e r e d

that the present Consumer Complaint being No. 99/2019 be and the same is dismissed for non-prosecution. There is no order as to costs.

            Let plain copies of this order be supplied to the parties free of cost as per provisions of law.
