ORDER

Today is fixed for admission hearing. Ld Advocate of the complainant is present and files hazira. The case is taken up for admission hearing. It is submitted by the Ld Advocate for the complainant that the op IOC installed pipe line under Neath the land of the complainant being plot no.478, Mouza Sibpur, of the Birbhum district and dug the field of the complainant of such installation of pipe line and therefore the complainant filed this case alleging defense in service against the op. Hd. the Ld Advocate for the complainant. Perused the complaint petition and other materials on record. It appears from the complaint petition and other materials on record and upon verbal submission of the Ld Advocate that the op. Laid pipe line under Neath the land of the complainant for meath passing crude oil or others for their own purpose.

Here in this case the complaints did not hire or availed of any service from the op by paying any consideration as laid down U/S 2(1) (d) of the consumer protection Act 1986 and therefore in our view the complainants are not consumer under the Op and the disputes is not a consumer dispute at all.

Hence it is ordered that the Consumer complaint being No. CC/16/2020 is dismissed without being admitted. Liberty is given to the complainants to file a afresh before the competent forum of Law it not otherwise barred.

Let the copy of this order be given to the parties as per CP Act 2005 free of cost.
