                                                            JUDGMENT

                        The facts of the complaint  in brief is that  the    complainant has placed an order for Shirt Mania-3 full sleeve shirts by Henry Hudson of 42 size  to the O.P 1 & 2 vide order No.989844683 dt.20/03/2016 over telephone during the month of March,2016 and the O.P 1 & 2  sent the ordered  through courier and the complainant received  the courier at Rayagada and on opening of the courier parcel  and while taking the measurement’s of the shirts all the shirts  are less then 42 size and the complainant immediately made call to the O.p1 and the O.P 1 agreed to exchange the shirts  and the complainant sent the product but it was returned due to insufficient address  and after that there is no response by the O.P 1. The O.P 1 assured to reimburse the postage charges by cash and informed that they nave sent a coupon by SMS  which is not received till date. Hence, prayed to direct the O.Ps to  refund  purchase price of shirts i.e. Rs.1098/-  and  pay Rs.1000/- towards the damages  and cost of litigation of aRs.500/-. Hence, this complaint.

                        Being noticed, the opposite party  neither appeared nor  filed any written version as such the O.p 1 & 2 were set exparte and inn absence of any written version from the opposite parties, we proceeded  the matter exparte and  believed  the allegations of the complainant  and  hence, we passed the order and  disposed of the matter with the following directions.

                                                              ORDER

                        The  opposite parties  are     directed to  pay the  cost of shirts  and shipping charges i.e. Rs.1098/- along with compensation of Rs.1,000/-  for mental agony undergone by the complainant and cost of Rs.500/- to the complainant within one month from the date of receipt of this order, failing which the O.P is  liable to pay  interest  @  12%  p.a. on the above awarded amount till  the date of payment.

                        Pronounced in open forum today on this 16^th day of September,2016 under the seal and signature of this forum.

                         A copy of this order as per the statutory requirements , be forwarded to the parties    free of charge.
