ORDER

Present:       Sh. Mustak Ali, Adv. for the complainant.

                    Sh. Naveen Kr. Khausal, Adv. for the respondent.

 

              This case is taken up on today before National Lok Adalat. Keeping in view, the statement dated 6.9.2023, suffered by the counsel for the respondent as well as counsel for the complainant, without making any adverse comment, on the act and conduct of any of the party, matter amicably settled.

                   Present complaint is, partly, accepted, holding the respondent, liable, to make the payment of claim, in the sum of Rs.28,000/- within 45 days, from the date of order, in default of it, respondent shall be liable to make the payment of simple interest @ 8% p.a., from the date of order, till actual payment of the claim amount of Rs.28,000/-. It is further, made clear, in case, in order to enforce this order, against the respondent, constrained the complainant to file the execution petition before the Commission, then, respondent may be liable to pay the expenditure, with regard to the execution proceedings, to the complainant, on the assumption of the Commission which may be assessed at an appropriate stage.

              Reader of this Commission, is directed to make necessary entry, in the System/Register, with regard to the disposal of the complaint, on today itself. File be consigned to the records.
