Complaint presented before the registry of this Forum on 19.2.2020 and put up before this Forum on today itself. It is hereby ordered to be registered against the registration number already allotted by the registry of this Forum.
Heard. In the case in hand, admittedly, the New India Assurance Company Limited has not repudiated or approved claim of the complainant partly or wholly. Neither any documents on record showing that complainant ever lodged her claim with the New India Assurance Company Limited and submitted or requisite documents. As propriety demands before institution of the complaint, legal notice has also not been served upon the opponent, the New India Assurance Company, the complaint is premature and liable to be dismissed.
Hence, due to the reason stated here-in-before, without commenting anything on the merits of the case, this complaint is rejected, it being premature. However, complainant, if advised so with served legal notice upon the New India Assurance Company Ltd. and it on receipt of legal notice from the complainant will do the needful either to approve or partly approve or to repudiate the claim of the complainant within the period of 45 days from the date of receipt of legal notice and the New India Assurance Company will communicate its decision to the complainant, in writin, as per the address mentioned in the legal notice itself. In case New India Assurance Company Ltd after considering the claim of the complainant repudiate the claim or allow it partly then, complainant shall be at liberty to file a fresh complaint against the New India Assurance Company Ltd., through its local Branch disclosing the particulars of this complaint and its fate. Alongwith legal notice complainant will also attach the copy of this order for information and necessary action by the New India Assurance Company Ltd. The death certificate pertaining to Sanjay Kumar and original Insurance Policy which is on record is hereby ordered to be released in favour of the complainant through her Advocate against proper receipt. File be consigned to the records.
