ORDER

CC No.331 of 2023.

Harjinder Singh     Vs.    The New India Assurance.

 

Present:        Sh. S.K. Dhanda, Adv. for the complainant.

                    

                   Complaint presented before the registry of this Commission on 06.09.2023 and put up before this Commission on today itself. It is hereby ordered to be registered against the registration number already allotted by the registry of this Commission.                

                   Complainant attached documents Ex.C1 to Ex.C8 with the complaint.

               Keeping in view the pleading of the complainant and supportive documents attached Ex.C1 to Ex.C8, it is crystal clear, the complainant lodged his claim under the insurance policy detailed in Para No.1 of the complaint, by filing claim form Ex.C5 dated 20.03.2022, but his claim has not been final settled by the opponent in either way which has made the complainant aggrieved. On the face of it, the complaint appears to be pre mature.

             This Commission is of the firm view, in case, time bound directions are given to the respondent to decide the claim of the complainant within specified period in either way, it will not cause any sort of prejudice to the respondent. At this stage, no notice is required to the respondent, giving opportunity of being heard, as no adverse order is being passed against the respondent at this stage.

                Without commenting on the merits of the case, at this stage, complaint of the complainant, is dismissed, as pre-mature with the direction, the complainant will submit his requisite documents with the respondent, if already not submitted within the period of 15 days from today, against proper receipt and thereafter, the respondent shall decide the claim case of the complainant within the period of 40 days from the date, it received documents from the complainant and in case, the complainant already submitted documents, then within the period of 40 days from the date of this order, in either way by passing speaking order as per its own wisdom and the respondent will communicate the order regarding settlement of his claim as per the address mentioned in the complaint and if, the complainant is not satisfied with the order of the respondent, then, the complainant shall be at liberty to file afresh complaint before this Commission and in afresh complaint, he will mention the particulars of this complaint and its fate and will also attach certified copy of this order with the fresh complaint. The complainant is directed to deliver the certified copy of this order upon the respondent either by hand or through registered post or any another legal mode, promptly. File be consigned to the records.
