Final Order / Judgement
Learned counsel for complainant has tendered into additional evidence copies of bills as Exhibit C-5 and C-6 and closed the same. Vide separate statement learned counsel for opposite party closed its rebuttal evidence. Written arguments also submitted by OP. 
Heard. It is the case of the OP that he has sent letter dated 26.12.2019 (Ex.OP-2) to the complainant calling upon him for submission of required information and documents for the settlement of the claim, but he failed to submit the required information. It is not the case of the complainant that he responded to this letter dated 26.12.2019 sent through registered posts by the OP for the settlement of the claim. In para No.8 of the written version it is submitted by the OP that the claim of the complainant has been approved as per report of Surveyor & Loss Assessor. The Surveyor & Loss Assessor has assessed loss to the tune of Rs. 10438/- and to pay the same, some documents were demanded from the complainant vide letter dated 26.12.2019 but he failed to provide the same.  It means the OP has not repudiated the claim of the complainant so far. As such, the complaint is pre-mature. Instead of submitting the required documents, the complainant has preferred to file the present complaint before this Commission on 18.3.2020. We are of the view that complainant was required to approach OP and justify his stand before coming to this Commission.
In view of our above discussion, the complaint stands disposed of. The complainant is directed to justify his stand by furnishing the required documents/ reply to letter under reference in respect of his claim within 30 days from the date of receipt of the copy of the order. Thereafter the OP will decide/pay the claim of the complainant, by providing complete details and by a speaking order, within further 30 days. If the complainant is not satisfied with the decision of the OPs, he shall be at liberty to approach any Court of competent jurisdiction.  Compliance of the order be made by both the parties in the manner referred above. In the peculiar facts and circumstances of the case, parties are left to bear their own costs.
