Today case is fixed for remaining arguments, but Counsel for the Complainant suffered a statement, which is recorded separately that due to some technical defects in the impleadings, he does not want to proceed with this complaint and same may be dismissed as withdrawn with liberty to file fresh complaint on the same cause of action and original documents be returned to Counsel for the Complainant.

In view of the statement given by Ld.Counsel for the Complainant, the present complaint is dismissed as withdrawn being having some technical defects in the impleadings, the applicant/complainant is allowed to file fresh complaint on the same cause of action and further period spent in this complaint from the date of filing till disposal, is to be excluded from the limitation, at time of filing fresh complaint and accordingly this complaint is dismissed as withdrawn. The original documents be returned to Counsel for the Complainant. File be consigned to the record room.
