He has suffered a statement withdrawing the present complaint on the ground that Opposite Party has repudiated the claim during pendency of the present complaint and has prayed for permission to file fresh complaint challenging repudiation of the claim. In view of statement made by Learned Counsel for the complainant, the present complaint is dismissed as withdrawn with permission to the complainant to file fresh complaint challenging the repudiation of claim of the complainant by the opposite party insurance company.
