Heard counsel for the Petitioner. Delay condoned. There are concurrent findings of two fora below and the payment has been made on the basis of surveyor’s report. Though the complainant had produced certain documents in support of his claim but no affidavit of the parties who had issued the documents had been filed. Thus, the complainant had failed to establish the expenditure incurred by him so as to rebut the report of the surveyor. In view of the above, we do not find that any case is made out for interference in the exercise of revisional jurisdiction under Section 21(b) of Consumer Protection Act, 1986 as we do not find any jurisdictional error, illegality or material irregularity in the orders of fora below. The revision is, therefore, dismissed with no order as to costs.
