Sh.Rajinder Sehgal, complainant has filed this complaint under Section 12 of the Consumer Protection Act,1986 ( hereinafter referred to as the Act) against the Opposite Party (hereinafter referred to as the O.P.) praying for the following reliefs:-

  1. To release the claim amount i.e. sum assured of Rs.8,00,000/- alongwith interest @18% per annum from the date of theft till realization;
  2. To pay Rs.1,00,000/- as compensation for causing mental agony and physical harassment ;
  3. To pay Rs.22,000/- as litigation expenses and

also to grant any other relief,which this Forum may deem fit.

The ld. counsel for the OP has tendered in evidence Ex.OPA affidavit of Sh.Ramesh Pandita, Ex.OPB, affidavit of Sh.B.R.Sharma alongwith documents Exs.OP1 to OP3 and closed the evidence of the OP.

  1. To pay the claim amount as per terms and conditions of the insurance policy alongwith interest @7% per annum from the date of repudiation i.e. 25.7.2016 till its realization. ;
  2. To pay Rs.10,000/-as compensation for causing mental agony and physical harassment to the complainant;
  3. To pay Rs.5000/- as litigation expenses.

The OP is further directed to comply the order within a period of 45 days from the date of receipt of the certified copy of this order. Certified copy of this order be sent to the parties free of cost under the Rules. Thereafter file be indexed and consigned to the Record Room.
