Appellant and respondent, both are remaining absent.  Due intimation of the date fixed of the appeal was repeatedly sent and last one was sent on 30/08/2012 by registered post acknowledgement due which was duly received by the appellant.  Since he is remaining absent and failed to prosecute the appeal effectively, we pass the following order :-

1.       Appeal stands dismissed for non-prosecution.

2.       No order as to costs.
