ORDER

The Complaint is allowed.Opposite party is directed to settle the Complainant's claim for Rs.3,50,000/- together with interest at the rate of 9% from 28/2/2002 i.e. date on which the survey report was drawn till its full payment.

The Complainant is also entitled to recieve the sum of Rs.10,000/- towards the retention charges paid by the complainant to Chowgule Industries .

The complainant is also entitle to a sum of Rs. 25,000/- towards mental agony and harassment and also Rs. 10,000/- towards cost of this complaint.

The Opposite Party is directed to remove the salvage from M/s Chowgule Industries Ltd., Fatorda.

The Opposite Party shall pay the amount within a period of 30 days from the date of this order forfeiting which the said amount shall carry an interest of 12% per annum.
