Decree holder Smt. Karuna Bala Mistri is personally present through her advocate  Rajesh Biswas by filing hazira.

Ld. Advocate      for the Judgment debtor is also present by filing hazira and presenting an account payee cheque in the name of decree holder dated 11-08-2010 for Rs. 72,800/- for compliance of the decreetal amount and prays for recall of W/A issued against the J. Dr., Sukumar Pradhan.

Ld. Advocate for the decree holder also files an application praying for dispose of the case on the ground of non prosecution stating that the decree holder already received the cheque vide no. 189573 for Rs. 72,800/- today and as such the decree holder does not want to proceed with the instant case.

Perused the application supported by xerox copy of account payee cheque, photo identity card, ration card and bank passbook duly signed by the decree holder and the money receipt being also identified by the ld. Advocate for the decree holder thereon.

It appears that the matter has been settled in between the parties to which the decree holder does not want to proceed with the case.

Having heard the ld. advocate for the parties and the decree holder as well in person. The decree holder received the decreetal amount with full satisfaction.
