Today is fixed for admission hearing.

Ld. Advocate for the complainant is present. It appears that an application praying for condonation of delay was filed by the complainant at the time of institution of the Consumer Complaint and the same was registered as MA/275/2023. 

MA is taken up for hearing.  Heard Ld. Advocate for the complainant on MA.

It appears that an award was passed by the Ld. Insurance Ombudsman on 06.01.2021 and copy of the award was delivered to the petitioner on 11.01.2021 during Corona Virus affected period. It is in the MA that the original copy of the award passed by the Ld. Ombudsman was misplaced and there is no scrap of paper in the Consumer Complaint even not annexed in the MA that the matter has informed to the local administration i.e. the local P.S. for the same. The inordinate delay about 30 months in filing the Consumer Complaint cannot be entertained as the same is hopelessly barred by limitation.

Hence, the CC being No. 146/2023 is dismissed being barred by limitation. 

The MA/275/2023 is disposed of.

The CDF Unit-II being No. 146/2023 is thus disposed of.
