1.             Varun Gupta, complainant has preferred the present complaint against the opposite parties (referred to as OPs in short) on the ground that he  invested an amount of Rs.48000/-  in the shape of FDR with OPs  on 18.06.2015 vide customer ID number 001717 and account number FD0051500089 for a period of one year and maturity value was Rs.53280/-.  The date of maturity of the FDR was 17.06.2016. After the maturity the complainant visited the OPs for the purpose of realization of the said FDR and submitted the bond and documents but the OPs run away after closing their branch. As such the OPs did not pay the maturity amount of the FDR. Thus, alleging deficiency in service on the part of OPs, the complainant has sought following reliefs:-

i)      OPs be directed to pay Rs.53280/- along with interest @18% per annum from 18.06.2016 till realization,

ii)     OPs be directed to pay to the complainant a sum of Rs.20,000/- on account mental agony and harassment and Rs.20,000/- on account of deficiency in service and unfair trade practice

iii)    OPs be directed to pay Rs.5,000/- as litigation expenses.

2.             Notices were sent to the OPs but none has appeared for the OP no.2 despite service. As such OP no.2 was proceeded exparte. The OP no.1 was given up by the learned counsel for the complainant.

3.             The complainant has tendered documents Ex.C-1 to Ex.C-3 and closed evidence.

4.             From the perusal of documents placed on the file and after hearing the arguments of the learned counsel for the complainant, we find that it is the case of the complainant that he invested an amount of Rs.48000/- in the shape of FDR with OPs  on 18.06.2015 vide customer ID number 001717 and account number FD0051500089 for a period of one year and maturity value was Rs.53280/-.  The date of maturity of the FDR was 17.06.2016which is evident from copy of FDR Ex.C-2 on record. The complainant has alleged that after the maturity of the FDR he approached the OPs to release the maturity amount submitted the bond and documents with the OPs but they did not release the maturity amount. The OPs have not come forward to contest the case of the complainant rather they chosen to remain exparte. As such evidence produced by the complainant has gone unrebutted on record.

5.             For the reasons recorded above, we allow the complaint and direct the OPs to pay to the complainant an amount of Rs.53280/- alongwith interest @9% per annum from the date of filing of the complaint till realization.
